GENERAL TERMS AND CONDITIONS OF SALE (GTC)
1. PREAMBLE
Welcome to the Montres Cimier SA website.
1.1. These general terms and conditions of sale (hereinafter referred to as "GTC") govern all offers, sales, and online purchases of products and/or services on the website(s) currently located at www.cimier.com. The terms of use of the website and the privacy policy applicable to the website are governed separately.
1.2. The website www.cimier.com is operated by Montres CIMIER SA, Chemin du Long-Champ 116, 2502 Biel/Bienne, Switzerland, which publishes all the content, including these GTC.
1.3. Please read these GTC carefully. These GTC apply to any order placed through the website or the customer service of Montres CIMIER SA. Please note that before placing an order for products or services, you will be required to accept these GTC. If you do not accept these GTC, you will not be able to order products or services on the website.
1.4. Montres CIMIER SA may revise these GTC at any time. However, this does not affect orders already placed, as previous versions of the GTC are archived by Montres CIMIER SA.
2. GENERAL PROVISIONS
2.1. These GTC apply to all orders, regardless of the country from which the order is placed and the country of delivery of the goods.
2.2. Only natural persons (not legal entities) who have reached the legal age of majority required to enter into contracts (eighteen years in most countries) and who have the legal capacity to enter into contracts may place an order (hereinafter referred to as the "Client"). If you have not reached the legal age of majority or are not legally able to enter into a contract, you must ask your parents or guardian to place an order on your behalf, and they will be required to accept these GTC.
2.3. The version of the GTC applicable to the Client is the one displayed on the website at the time of placing the order.
2.4. By placing an order via the website www.cimier.com, the Client declares that they (or one of their relatives) will be the end user of the product, acquired for exclusively personal use. Any purchase on this site for commercial purposes, of any kind, is strictly prohibited.
3. ORDER
Product Availability and Quantity
3.1. The products offered for sale by Montres CIMIER SA are those listed on the website www.cimier.com at the time the Client consults the site.
3.2. The products offered for sale are subject to stock availability. If a product ordered is out of stock, CIMIER undertakes to inform the Client as soon as possible by any appropriate means. In agreement with the Client, a new delivery date may be agreed upon. Otherwise, CIMIER will proceed with the refund of the amounts paid by the Client. In either case, no compensation will be due.
3.3. Quantity limits may apply to orders of certain products. Montres CIMIER SA reserves the right to refuse orders exceeding a certain number of products without prior notice.
Placing the Order
3.4. The ordering process requires the following steps:
1. Add the item(s) to the shopping cart
2. Provide all necessary order information
3. Enter the required details and ensure the accuracy of the provided information
4. Read and accept the GTC by checking the box "I have read and accept the terms and conditions of the site"
5. Conclude the sales contract by confirming the order
6. Pay the indicated price using the available payment solutions
At the end of these steps, the Client will receive an order confirmation by email.
Order Validation
3.5. Montres CIMIER SA reserves the right to cancel an order if the payment authorization fails or if certain information provided during the process is incorrect (e.g., incorrect delivery address, email address error, non-existent phone number). In such cases, Montres CIMIER SA will inform the Client as much as possible and/or simply refund any received payments.
3.6. Orders will only be considered final when full payment has been verified, and Montres CIMIER SA has confirmed product availability (this verification is carried out as soon as possible after sending the email confirming receipt of the Client's order). Further details on payment are provided below.
3.7. Order confirmation is sent via email to the address provided by the Client and includes contractual information such as product details, order reference number, and invoice (total order amount, including product prices and shipping fees).
3.8. The Client is responsible for securely storing the contractual information on the medium of their choice.
4. PAYMENT
Prices
4.1. The prices indicated apply only to the product itself. They do not include shipping costs (calculated approximately at checkout) or any applicable import taxes, customs duties, VAT, or other charges. For orders with a delivery address in Switzerland and Germany, VAT is calculated and added at checkout. For all other countries, the Client is responsible for paying VAT, customs duties, and any other applicable taxes in the delivery country. It is the Client’s responsibility to inquire about these charges before placing an order. Montres CIMIER SA cannot be held responsible for the payment of these charges or for any customs retention abroad.
4.2. Montres CIMIER SA reserves the right to change prices and shipping costs at any time without prior notice.
Payment Methods
4.5. Payment is made online by credit card. The following credit cards are accepted: Mastercard, Visa, American Express, and UnionPay. Payments are encrypted, secured, and, in principle, processed immediately by our banking partners.
5. DELIVERY
Delivery Times
5.1. Unless otherwise agreed, products ordered are generally shipped within thirty (30) business days from the date of written order confirmation.
5.2. Orders are shipped Monday through Friday, between 08:00 and 17:00, excluding public holidays. A shipping confirmation email with the invoice and tracking information will be provided to the Client on the day of shipment.
Delays in Delivery
5.4. If the shipment of products is delayed beyond twenty (20) business days from the indicated order date or the aforementioned 30-day period, our customer service will inform the Client. If the shipment delay exceeds fifty-one (51) days and the Client refuses to agree on a new delivery date, our customer service will offer to cancel the order and refund all amounts already paid for unshipped products.
5.5. The risk of loss or damage to the product transfers to the Client at the time of shipment, i.e., once the package is handed over to the postal service or carrier.
